By checking the “By placing your order, you agree to our Terms of Sale” box and clicking the “Place Order” button, or by making any purchase via the Summit 3D website, you acknowledge that you have read, understood, and agreed to be bound by these Terms, the Website Terms of Use, and our Privacy Policy.
Summit 3D Pty Ltd is a private company registered in the Republic of South Africa. All transactions are processed in South African Rand (ZAR) unless otherwise stated. You must be at least 18 years old to place orders.
1. Order Confirmation and Acceptance
Invitation to Treat: Information on this website is an invitation to treat and does not constitute a binding offer.
Order Placement: Your order constitutes an offer to purchase. Summit 3D reserves the right to reject any order (e.g., due to stock unavailability or pricing errors) prior to shipment.
Confirmation vs. Acceptance: You will receive an automated Order Confirmation email upon payment. However, a legally binding contract is only formed when you receive a formal Order Acceptance or Shipping Notification email.
Cancellations: You may cancel orders that have not yet been dispatched by contacting info@summit3d.co.za.
2. Pricing and Payments
Errors: While we strive for accuracy, errors may occur. If a product is listed at an incorrect price, we reserve the right to cancel the order. If you have already been charged, we will refund the full amount.
VAT: All prices are inclusive of Value Added Tax (VAT) at the current statutory rate unless otherwise indicated.
3. Shipment and Delivery
Estimates: Shipment dates are estimates. If we cannot fulfill an order within 30 days (as per ECTA requirements), we will notify you, and you have the right to cancel for a full refund.
Risk: In accordance with the CPA, the risk of loss or damage passes to you upon physical delivery to the address provided or when a person at that address accepts the delivery.
Discrepancies: Please inspect goods upon receipt. Notify us of any missing or damaged items within 48 hours of delivery.
4. Statutory "Cooling-Off" Period (ECTA)
In terms of Section 44 of the ECTA, you are entitled to cancel your purchase within 7 days of receipt of the goods for any reason, provided:
The goods are in their original packaging and in a resalable condition.
You will be responsible for the direct cost of returning the goods (shipping).
Note: This does not apply to software that has been unsealed or personalized/custom-made items.
5. Refunds, Returns, and Repairs (CPA)
Beyond the 7-day cooling-off period, our returns policy is governed by the Consumer Protection Act:
Defective Goods: If a product is found to be defective within 6 months of delivery, you are entitled to a repair, replacement, or a full refund (your choice). This does not apply to defects caused by normal wear and tear, negligence, or unauthorized alterations.
Hardware Returns: Must include all original accessories, manuals, and packaging.
Software: Digital products and software keys are non-refundable once the key has been viewed or the download initiated.
6. Warranty
Summit 3D provides a one-year limited manufacturer warranty from the date of delivery. This warranty runs concurrently with, and does not limit, your statutory rights under the CPA regarding defective goods.
7. Export Control
Products sold by Summit 3D are intended for use within South Africa. If you intend to export these products, you are responsible for complying with all South African export regulations and the import laws of the destination country.
8. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa.
Dispute Resolution: In the event of a dispute, we encourage you to contact us at info@summit3d.co.za first.
Arbitration: If a dispute cannot be resolved, it shall be referred to arbitration in accordance with the Rules of the Arbitration Foundation of Southern Africa (AFSA), with the seat of arbitration being in South Africa.
Small Claims: Nothing in this clause limits your right to approach the National Consumer Commission or a Small Claims Court where applicable.
